New analysis finds that the source of funds preparation, partial funding traps, and widespread deadline misinformation are leaving visa holders dangerously exposed

The findings indicate that a combination of deadline misinformation, source of funds preparation delays, and partial funding traps are leaving a significant portion of eligible visa holders unable to file before the window closes, despite having the financial means to qualify.
Finding 1: Most visa holders misunderstand what September 30, 2026 actually means
September 30, 2026 is widely and incorrectly cited across the EB-5 market as the expiration date of the Regional Center Program. It is not. The Regional Center Program is authorized through September 30, 2027. The 2026 date is a grandfathering protection milestone. Investors who file their I-526E petition on or before September 30, 2026 are guaranteed to have their petitions processed under current rules regardless of what Congress does in 2027. Investors who miss this date lose that guarantee and face exposure to a projected inflation adjustment raising the minimum TEA investment from $800,000 to between $920,000 and $940,000 on January 1, 2027. The widespread misrepresentation of this deadline by brokers and regional centers has created both panic and complacency, neither of which serves the investor.
Finding 2: Source of funds preparation is taking longer than investors expect
USCIS requires a complete and unbroken chain of evidence proving every dollar of the $800,000 investment was obtained lawfully, covering at least seven years of financial records including tax returns, bank statements, brokerage statements, and property records. Even for straightforward cases, an experienced immigration attorney typically requires four to six weeks to compile a compliant filing package. Investors who have not yet engaged legal counsel as of today have fewer than 40 days before the September 30 deadline, which is insufficient time to prepare documentation, conduct project due diligence, and file. StudentEB5's analysis indicates that the source of funds preparation timeline is the primary reason eligible investors miss the grandfathering window, not lack of capital or intent.
Finding 3: The H-1B layoff wave has created a new class of urgency
More than 110,000 tech employees were laid off across 144 companies in Q1 2026 alone. The top H-1B sponsors, including Amazon with 4,831 FY2026 approvals and more than 30,000 jobs cut, Meta with 1,606 approvals and a 10 percent workforce reduction, and Cognizant with 2,657 approvals and 12,000 to 15,000 cuts planned under Project Leap, are simultaneously the largest sources of H-1B terminations. A laid-off H-1B worker has 60 days to find a new sponsor, change status, or leave the country. Concurrent EB-5 filing, which grants an Employment Authorization Document and Advance Parole within four to eight months of filing, is the only mechanism that removes employer dependence entirely. Workers who file before September 30, 2026 lock in this protection under grandfathered rules.
Finding 4: International students face a compounding disadvantage
The lifetime earnings gap between international students who secure permanent residency in the United States and those who return home approaches $3 million to $4 million over a 40-year career, based on data from the Economic Innovation Group and Georgetown University Center on Education and the Workforce. Despite this, F-1 students face a sub-20 percent H-1B selection rate, a $100,000 fee on most new petitions, and a wage-weighted selection model that favors mid-career hires over recent graduates. The EB-5 program, which requires no employer sponsorship and can be filed concurrently with an adjustment of status while the student is still in valid nonimmigrant status, is the most direct alternative available. Green card holders additionally gain access to Pell Grants and federally subsidized loans unavailable to nonimmigrant visa holders.
Finding 5: Filing surge bottlenecks are already forming
The convergence of the September 30, 2026 grandfathering deadline, the January 1, 2027 investment increase, and the September 30, 2027 program expiration is driving successive waves of filing surges that are straining the capacity of regional centers, immigration attorneys, and USCIS simultaneously. Investors who delay filing face not only higher costs and reduced legislative protection but also the practical difficulty of securing competent legal representation and viable project allocation in a market where both are increasingly scarce.
